Hi all,
Say, does anyone know where the image at the top of the EWnF template came from and if we have full useage over it in our websites? I just don't want another Getty nightmare on my hands.

Hi, the best bet is to look at the creator links in the footer, and contact the original creator...
The templates I converted were all originally taken from O/S template sites, so I'm not sure about rights on images - like I say, contact the original creator...

I personally don't think that there would be an issue using the template, as after all, the user released the template on a template site for free download...

I haven't heard back yet, but will be sure to post the outcome. Keep in mind that this is exactly what happened to get Corbis to sue Template Monster. There were people creating and selling their templates that contained stock photos from Corbis without permission to do so. Getty is also tracking down any website containing their images and then is fining people for lost royalties. link to discussion Getty actually has a web bot that goes out looking for these images. It will find most of them even if you don't see a visible watermark as well as images that aren't even linked to on an html page (just sitting there on the server). So, everyone be very careful about images you use.

The only true method of determining copyright of images is to either have the information coded into the image or to have it visibly embedded within the image itself... Without such integrated copyright information any claims of ownership are subject to speculation... I'm sure that some folks might have differing opinions on the subject but in a world where negatives are going the way of the dinosaur the proof has to be in the pudding... Most graphics packages will divulge any embedded image information which might contain a copyright...

Thats one large thread! I've just spent god knows how long looking through it, and I'm gonna have to talk to ralph anyway about protecting ourselves from such instances in the future...

It sure is! I started reading it before Christmas and just started trying to catch up. Still not through it yet. One difficulty is weeding out the US versus UK copyright discussions. It makes me afraid to create any websites. oof!

I've just sent this to all my clients:
Dear Etomite Hosting Client,
You are receiving this e-Mail, as your e-Mail address is registered on file with an account on our system.
This is an important e-Mail regarding images on websites, and copyrights of those images.
There is a new "craze" going round the internet, of image distribution companies suing website owners over copyright of images held on websites.
If you don't know where an image has come from, then I'd advise you replace it with one that you know where it's come from. Simple? If only!
Some websites claim to offer royalty-free images - be very careful of these sites! You could actually be receiving an image that someone is trying to pass off as their own image, and if caught, could end up costing you... not your website designer, not the person giving you the images, not your host, but you: the website owner. Some people have had to spend a few thousand pounds off the back of these images, by settling out of court. Quite simply, if you didn't take the photo, you don't own the copyright.
Some websites have used the same image(s) for the last couple of years on their website, and still be successfully billed for the images. The companies that took the photos have a technology to find the photos - even if you resize them, they can still find them. Theres something physically coded into the photo - a "digital watermark". They then invoice the website owner for (on average) £1K + Vat per image, and if you don't pay, they pass it onto a bailiff/debt collector. Now I can't comment on the legality of this process, but the best way not to get these fines, is to make sure that you know that you have permission to use the images to start with.
So, if you don't know if an image on your website could end up costing you, check.

I would also add onto that to read through the image license information on sxc.hu as well. Stated in there they have "SXC cannot be held responsible for any copyright violations, and cannot guarantee the legality of the Images stored in its system. If you want to make sure, always contact the photographers. You use the site and the photos at your own risk!"Jenifer

You could also buy them at a dollar a pop from istockphoto.com - that way you'd really know you owned rights to use them, and $1 is a lot cheaper than £1000. Of course, you couldn't put them in templates and distribute them to other people, but for an image that you'll only use on your own site (or on a client's site that you're building) it's a bargain.
